The Borgarting Court of Appeal ruled in favor of MMA athlete Geir Kåre Nyland, who sued Oslo municipality after sustaining permanent injuries in a diving accident in Bjørvika in 2021.
Nyland was paralyzed after plunging from the edge of the wharf. Oslo municipality has lost in both trials in the district court and the court of appeal.
The verdict from the Borgarting Court of Appeal emphasized that the accident could have been avoided with better signage.
Warning signs about shallow water and diving prohibited were put up every 10 to 14 metres. Nyland thought this was too little.
Oslo municipality therefore appealed the case to the Supreme Court and wants them to clarify where the limit is for municipalities’ responsibility in preventing accidents.
