– In my opinion, the Board of Appeal must take the case up for consideration again and annul this decision, says Jan Fridthjof Bernt, who is professor emeritus of jurisprudence at the University of Bergen, to Chrono.
Earlier this month, it became known that Felle’s appeal board upheld the conclusion of Nord University that Kjerkol and her fellow student had intentionally cheated in the master’s thesis they submitted in 2021.
The case became known after VG in January this year, several pointed out textual similarities with other academic assignments, but already in the censoring in 2021, the examiners knew that there were some textual similarities without thinking it was alarming.
The joint appeals board has referred to the information on text similarities from 2021, but has thus come to a different conclusion than the examiners.
After the decision of the Joint Appeal Board, Kjerkol and the fellow student have said that they are considering suing the state.
Bernt believes, like Kjerkol’s lawyer, that the appeal boards cannot without further ado change a decision, such as a thesis censorship, to the disadvantage of the person concerned. Nor can they reverse the decision just because you disagree with it, he believes.
Head of the Joint Complaints Board, Ernst Nordtveit, writes to Khrono:
– I can only point to the reasons for the decision, where the Joint Complaints Board has assessed the issues raised by Bernt, and has come to a different result than him.
