Judge Anne-Lene Åvangen Hødnebø believes there is good reason to suspect Høiby of two of the rapes. That is to say, the court believes that it is overwhelmingly likely that he is guilty.
But in connection with the third and last rape, which is said to have been filmed, the judge writes that she has come to this conclusion with doubts.
The judge points out that the victim has explained that she has previously had sex with Høiby on several occasions and that she has also allowed him to film her along the way. Hødnebø nevertheless believes that it is most likely sleeping when the act Høiby is charged with took place.
The judge also points out that the victim has not yet explained himself about the relationship.
There was previously a ban on reproducing the ruling publicly, but the Oslo District Court decided on Tuesday that this should be lifted after several media outlets requested a reversal of the decision.
