Roberson, who was convicted in 2003, was scheduled to receive a lethal injection on Oct. 17. But a judge agreed to the request of the state’s elected representatives to delay the execution until Roberson can explain the case in a hearing.
On Friday, the Supreme Court decided that an execution cannot be postponed because of a subpoena. This means that the execution can be carried out.
The lead investigator in the case from more than 20 years ago has stated that he believes Roberson is innocent. Elected officials from both the Republicans and Democrats have since tried to stop the execution.
If nothing unforeseen happens, Roberson will be the first in the United States to have a death sentence carried out for shaking a child.
